The urgency of protection of Data Privacy Act

      I have attended the meeting about data privacy in Millenium Hotel, from 8-3 pm about The urgency of the protection of the Data Privacy Act.

Background

   Many law problems happened in Indonesia such as the leakage of data customer telecommunication amount twenty-five million rupiahs in 2011, the total of spam offer credit without collateral by broadcast messages, and data customers with credit cards had distributed inter-banking and agency. There is some regulation to guarantee the rights of privacy like:

• Universal of Human Rights article 12

• ICCPR is ratified by the Law Number 2 of 2005

• Convention on The Rights of The Child article 16 is ratified by Presidential Decree 36/1996

• International Convention on The Protection of The Rights of All Migrant Workers and members of their families article 14 is ratified by the Law Number 6 of 2012
  

    The regulation of data privacy in Indonesia:

• The Law No 23 of 2006 about Civil Administration articles 86 and 87

• The Law No 11 of 2008 about Information and Electronic Transaction article 26

• The Law No 36 of 2009 about healthy

• The Regulation of Ministry of Communication and Information Technology No 23 of 2005 about  Telecommunications Customer Registration

• The Regulation of Bank of Indonesia No 7 of 2005  about banking.

Theme 1, The urgency of the Protection of Data Privacy Act 

Presenter 1, Dean of University of Malaya, Prof. Abu Bakar
Munir was explained about Data Privacy Act in Asian Country
especially Malaysia. There is some regulation that explains

about data privacy about Cairo Declaration about Islam Human

Rights,  APEC Privacy framework 2004, Declaration of Rights

ASEAN 2012, and e-ASEAN Framework Agreement.

Presenter 2, Dean of Law Faculty of The University of
Padjajaran, Dr. Sinta Dewi, S.H, LL.M
She explains the definition of data privacy, survey
the result shows low the awarenessIndonesian Society to
protect data privacy, international regulation about data
privacy, and how to regulate data privacy in Indonesia.

Presenter 3, Secretary of Directorate General of Information and Communication Public, Drs. IsmailCawidu, MM

He explains the Ministry of Information and Communication Technology Regulation which includes data privacy like the Law of Information and Electronic Transaction, the Law of Public Disclosure, The Government Regulation about Implementation of Electronic Transaction Systems, The Law of Telecommunication, and Academic Paper is made by The Ministry of Administrative and Bureaucratic Reform. about The Protection of Data Privacy in Indonesia.
 

Theme 2: The Protection of Consumer Data Privacy in Indonesia

Presenter 1 Executive Director of ELSAM, Indriaswati Dyah Saptaningrum, S.H, LL.M

give the presentation about the normative framework which guarantees the protection of data privacy. He is concerned about the importance of definition and elements of data privacy, the boundary is allowed

and legal to access and use data privacy by a trusted party, and the protection of infringement about the security of data privacy. There is some threat to data privacy and interception mechanism.

           

Presenter 2,  Chairman of the Indonesian Consumers Foundation, Sudaryatmo, S.H

is talking about aspects of protection of data privacy like regulation, self-regulation, the education for consumers,  technology approach "privacy certified" and institution approach (chief privacy officer)       

Theme 3: The Protection of Data Privacy is linked by the-KTP Program

Presenter 1, The Chief of Sub Directorate Population Data Management, The Ministry of Public Affairs, Ir. Husni Fahmi, MSEE explains about e-KTP Program. For the protection of data privacy, they do information security of data population in the e-KTP program, such as:

• Operator onboarding must do log on and fingerprint.

• using a virtual private network

• Datacenter is protected by physical protection, access control, and key management system with the hardware security module.

• Personalization with encrypted data.

• Chip and reader with mutual authentication, encryption, digital signature, and CC EAL4+.

Presenter 1, Mr. Wina Armada Sukardi, SH, MBA, MM more concerned about the importance of synchronization of the Law of Public Disclosure with the protection of data privacy  (the information is secret and privacy).
